We’re glad you’re using BitsaboutMe! These General Terms and Conditions (“GTC”) govern the contractual relationship between BitsaboutMe AG, with its registered office at Marktgasse 50, 3011 Bern, Switzerland (“BitsaboutMe”) and you (“you”) as a user of our services (“Services”) as well as the rights and obligations in this context.  Our privacy policy  explains how we handle, store and process your data. Additional provisions may apply to individual services. Privacy policies and additional provisions are integral parts of these Terms and Conditions. Please read the Terms and Conditions and Privacy Policy carefully.

1.     General

By registering and using our services, you agree to the applicable provisions of these Terms and Conditions and the Privacy Policy. If you do not agree with or violate any of these terms, you are not entitled to use our services.

BitsaboutMe reserves the right to exclude you from using some or all of the Services and/or to temporarily or permanently block access to your personal BitsaboutMe account (“Account”) if there are legitimate reasons (such as a violation of these Terms and Conditions).

BitsaboutMe reserves the right to make changes to these Terms and Conditions and the Privacy Policy from time to time and to publish the current version on our website. You will be notified of any significant changes by e-mail within a period of at least 20 days before they come into force. By continuing to use our services after the changes take effect, you agree to the changed terms. If you do not agree with the changes and therefore wish to terminate the contractual relationship with BitsaboutMe, you have the option of completely and irrevocably deleting your account, your personal data storage (“PDS”) and the associated data at any time in the account settings.

2.     Services

BitsaboutMe provides you with  the following services via your account (see section 3 below):

Personal Data Storage (“PDS”): Each account is linked to a Personal Data Storage (“PDS”), which allows you to easily import data from various third-party sources and store it individually encrypted on your PDS. We prepare this data for you, create a profile and provide you with an overview of who stores which data about you (see section 4). You will then have various options for viewing, editing and sharing this data via your account.

 Nutrition and sustainability analytics (“widgets”): BitsaboutMe analyzes your shopping data in terms of nutrition andsustainability. The results are presented to you in the form of interactive graphics (widgets). This information is used to improve one’s own diet or the sustainability of one’s own purchases.

3.     Requirements and Responsibilities for Use of the Services

To use our services, you need a personal BitsaboutMe account. Choose a valid e-mail address as your username and protect your account with a personal password. You can also generate an individual login recovery code in case you can’t remember your username and/or password. Make sure your account information is accurate and up-to-date, and always keep your password secret and secure. With the successful opening of an account, your contractual relationship with BitsaboutMe begins with the rights and obligations set out herein.

The use of the services is carried out by remote access via the Internet. The transfer point for BitsaboutMe’s contractual services is the router output of the data center used by BitsaboutMe. Your connection to the Internet, the maintenance of the network connection as well as the procurement and provision of the hardware and software required for you is not the subject of this contract.

The use of our services is only open to natural persons with unlimited capacity to act. Minors (persons under 18 years of age) are excluded from use.

You undertake not to use our services only to the extent permitted by law and not to provide or share any data and content that violates the rights of third parties (such as intellectual property or personal rights), is otherwise illegal or immoral or violates other requirements of BitsaboutMe. In particular, content for which you do not have the appropriate authorization (such as intellectual property, rights to edit in accordance with data protection law, etc.) is inadmissible. BitsaboutMe disclaims any responsibility in connection with your data. In addition to complying with applicable standards of Swiss law, you are responsible for complying with any applicable law in your country of residence or residence. BitsaboutMe is entitled to immediately delete data that violates the provisions of this section.

You will refrain from any attempt to retrieve information or data without authorization, either by yourself or through unauthorized third parties, or to interfere or have interfered with programs operated by BitsaboutMe or to penetrate BitsaboutMe’s data networks without authorization.

You are solely responsible for deciding what data you upload to your PDS, includingwith respect to data sources that our Services offer or recommend to be linked. You agree to link only data sources to your PDS where you are authorized. We have no control over the content, accuracy, practices, or legality with respect to these third-party sources. We are not able to monitor, verify or even censor the content of third-party sources. Third-party sources may have their own legal terms and conditions and privacy policies that apply to you and that you are solely responsible for complying with. We are not responsible for any loss or damage arising from your access to or use of these third-party sources.

The use of mechanisms, software or other scripts that could interfere with or otherwise affect the proper operation of our services or third-party accounts is prohibited.

You are responsible for immediately notifying us of any unauthorized use of your account and/or password. You are solely responsible for anything caused by your account, unless you close it or have reported abuse to us.

Should you violate your obligations arising from the present contractual relationship and BitsaboutMe is held liable for this, we undertake to indemnify BitsaboutMe against all claims and to indemnify them in full (including lawyer’s fees and court costs).  If you make a claim or bring an action by a third party, or if we believe that you are or may be in breach of this Agreement, we may, in our sole discretion, terminate your account and delete your information from your PDS, with or without notice.

4.     Data processing and access

BitsaboutMe pays the utmost attention to your personal data and provides the highest possible protection. Our Privacy Policy  explains how we do this.

Your data, our services and your consent – In order to use BitsaboutMe’s services, you provide us with data. Unless otherwise stated in the provisions of these T&Cs, the Privacy Policy or applicable data protection law,  your data always belongs to you and BitsaboutMe has no rights to your data.

Your data at BitsaboutMe is always stored in encrypted form . Only you have the key with your password to access your account or the PDS associated with it and decrypt the data stored there. The data is only available unencrypted in the PDS if and for as long as you are logged into your account with your password.

Our services enable you to upload data from third-party sources or directly into your PDS and have it analyzed, evaluated and visualized by BitsaboutMe, as well as to search, edit, export, delete data and,   with explicit consent, leave it to BitsaboutMfor furtheruse in research. .  These services require access and processing of your data by our systems. For example, you can change your existing accounts with predefined third-party providers (e.g. Migros Cumulus or Apple Health) to your PDS. In doing so, you place the order with BitsaboutMe and give your explicit consent to provide a complete or partial copy of the data stored there (e.g.Purchase data or  content of your Apple Health Center)  via interface (API or scripts) into your PDS. 

In order to be able to carry out and further develop our services on your behalf as described, you give us and the contractual partners we call in the necessary consent – i.e.  a non-exclusive, free, worldwide right – to host, store, encrypt and decrypt, edit, analyze, visualize, generate new data sets from existing data, export and delete your data without further notice. You give this order and the corresponding consent with each connection of a third-party source to your PDS.

BitsaboutMe never shares data from your PDS with third parties without your explicit consent. Only anonymized or prseudonymized data will be  shared, for which you have given explicit  consent, which you can revoke at any time.

5.     Intellectual property and software

All intellectual property rights used and displayed in connection with our services, e.g. Product names, designs, images, photos and text are the property of BitsaboutMe or its licensors. Any use outside of the legally permissible personal use is prohibited unless BitsaboutMe or the corresponding licensor has given express written consent.

Our services are executed by different software. In order for you to use our Services, we (and our licensors) grant you a purpose-limited, personal, worldwide, non-exclusive, non-transferable, non-sublicensable, revocable at any time. Subject to mandatory legal provisions, you are not permitted to copy, modify, distribute, sell or otherwise share our services, the software contained therein or parts thereof or to disassemble the software or attempt to extract the code of the software.

Open source software plays an important role for us. Parts of the software are licensed as open source software. A list of the open source licenses  used can be found on our website .

6.     Involvement of third parties

BitsaboutMe may use third parties (“third parties”) to provide its services. The third parties either act as an assistant to BitsaboutMe or you conclude a separate contract directly with you.

For example, individual functions may provide for interactions between you and third parties or their services. For example, these services can make it possible for you. allow content and data to be shared with third parties, which will then be processed through the services of third parties. BitsaboutMe has no influence on such third-party services and their contents. It is the sole responsibility of the participant how he interacts with such third-party services. BitsaboutMe assumes no guarantee, responsibility or liability for the contractual relationship between the participants and third parties.

7.     Modification and termination of our services

We are constantly changing and optimizing our services. For example, we may add or remove functionality or features, and we may also suspend or permanently discontinue a service.

You can cancel your use of our services at any time. BitsaboutMe may suspend, limit or completely cancel the provision of services to you at any time. 

Your data belongs to you and it is important to us that you can access your data in the event of termination. Therefore, if we discontinue our services, we will, where reasonably possible, notify you in advance and give you the opportunity to export your data.

If you cancel, you are responsible for exporting your data beforehand. If  you have not used our services for more than 12 months, we will ask you by email to confirm that you wish to use our services for longer. Without such confirmation, or if you have terminated, and provided that there are no legal retention obligations or you still have open marketplace credits, BitsaboutMe will irrevocably delete your account with all data. In the case of an open marketplace balance, we will transfer it to your bank account, provided that you have entered an IBAN number in your account settings. Without providing an IBAN number, we will remind you at monthly intervals by  personal e-mail to deposit an IBAN number for payment. If you do not do this, we will charge  your wallet a monthly administration fee of CHF 1.00 and offset this against your balance. Ifyour wallet has no more credit, it will be irrevocably deleted with all data.

8.     Warranty

We strive to provide excellent services. However, there are some things for which we cannot guarantee and therefore cannot accept any liability. 

Except as expressly stated in these Terms and Conditions, neither BitsaboutMe nor its affiliates make any specific representations with respect to the Services. The Services are provided as is. We therefore make no warranties, express or implied, regarding the content in our Services (including the absence of defects of title), with regard to specific functionalities of the Services or their reliability, availability, accuracy or suitability for certain purposes. BitsaboutMe also has no influence on the effects of third-party systems on the services and therefore assumes no warranty or liability in this context. In addition, the services or individual functionalities may temporarily not be available or may only be available to a limited extent due to maintenance work or other important reasons.

Some jurisdictions do not allow the warranty and liability disclaimers described in this section. It may therefore be that these do not apply to you.

9.     Limitation

This disclaimer or limitation of liability to you does not apply where it would be contrary to applicable law. In addition, this paragraph does not affect consumer rights that cannot be excluded or restricted by contract or agreement. BitsaboutMe is liable in accordance with the statutory provisions for direct damages caused by an intentional or grossly negligent act of its own. The same applies to the explicit assumption of guarantees or other strict liability as well as to claims arising from the Product Liability Act or culpable injury to life, limb or health. 

BitsaboutMe’s liability for direct damages in the event of slight negligence – regardless of the legal reason – is expressly excluded, subject to mandatory statutory provisions. BitsaboutMe’s liability for indirect damages or consequential damages – regardless of the legal basis – as well as for contractual partners involved is fully and expressly excluded.

In the event of liability that we cannot exclude by law, we shall, as far as possible, limit our liability to you to the foreseeable damage typically incurred.

10. Dispute Resolution and Governing Law

Whenever and wherever possible, we would like to resolve your problems with BitsaboutMe out of court. Before filing a lawsuit against BitsaboutMe, first seek an informal resolution of the dispute by contacting info@bitsaboutme.ch. We will endeavor to resolve the dispute informally via email. If a dispute is not resolved within 30 days of submission, you or BitsaboutMe may initiate formal proceedings. Unless otherwise mandatory statutory provisions, the place of jurisdiction is Bern, Switzerland.

Unless otherwise stipulated by law, all disputes between you and BitsaboutMe in connection with the Services and these Terms and Conditions shall be governed by Swiss law to the exclusion of the Vienna Convention on Contracts for the International Sale of Goods.

11. Other provisions

Should individual provisions of these terms and conditions be invalid or ineffective, this shall not affect the validity of the remaining provisions and these terms and conditions as a whole. Insofar as these have not become part of the contract, the content of the agreement shall be governed by the applicable statutory provisions.

These T&Cs govern the entire relationship between you and BitsaboutMe. Prior or contrary agreements are excluded. No claims or rights are established for third parties.

Any failure by BitsaboutMe not to invoke a clause does not mean that it will not apply at a later date.

The rights granted under these terms and conditions (in particular your account) are not transferable without our written consent. BitsaboutMe may transfer any or all of its rights and obligations under these Terms and Conditions to a third party or have them exercised by a third party without your consent; you can find more information about this in our privacy policy.


In the event of any contradictions or questions of interpretation between the German and English versions of these GTC, the German version shall prevail.
